FUEL CAP REPLACEMENT

December 21th, 2012

Re: Fuel Cap Replacement

Dear Can-Am On-Road® Owner,

This notice is sent to you in accordance with the requirements of the National Traffic and Motor Vehicle Safety Act, the Canada Motor Vehicle Safety Act, the U.S. Environmental Protection Agency (EPA), the California Air Resources Board (CARB) and Environment Canada. Bombardier Recreational Products Inc. and BRP US Inc. (“BRP“) have decided that a defect which relates to motor vehicle safety exists on certain Can-Am Roadster models and are conducting a safety recall.

Which models are involved?

Can-Am Roadster model year 2008 to 2012.

What is the potential problem?

The fuel cap may not seal properly with the fuel tank filler neck. Fuel vapors in the presence of an ignition source could result in a fire.

To confirm that your VIN (Vehicle identification Number) is affected, contact your authorized Can-Am On-Road dealer or BRP at 1-888-272-9222 between 8:00 a.m. and 8:00 p.m. Eastern time 7 days a week.

What will BRP do?

For dealers: BRP is publishing a Safety Campaign bulletin giving the procedure to replace the fuel cap with an improved version.

For customers: Starting in January and over the following 4 to 8 weeks, BRP will be sending to all known registered owners a Safety Recall package that will include a letter and an improved fuel cap for them to install. Please note that the shipping will be prioritized according to seasonality. A postage free return card will also be included in the Safety Recall package for customers that no longer own the vehicle or if the owner's information in the notice is incorrect.

Also, BRP is posting this notice and attached Safety Campaign Bulletin on its dealer website BOSSWeb (www.bossweb.brp.com). Information for customers is posted on BRP's public website (www.can-am.brp.com).

What should you do?

For unregistered units as of December 21th 2012:

  • Do not sell or deliver any involved vehicle that you have in stock as federal law requires you to complete the recall service on these vehicles before retail delivery.
  • Follow all instructions provided in the attached Safety Campaign Bulletin (2012-13) for repair and claiming procedures.

For registered units as of December 21th 2012:

  • As previously mentioned, BRP will ship a Safety Recall package to all known customers. In the event that a customer contacts you and is asking you to perform the recall, please proceed with the repair and process the claim according to the Bulletin 2012-13.

Please note that the National Traffic and Motor Vehicle Safety Act provides that each vehicle which is subject to a recall campaign of this type must be adequately repaired within a reasonable time after the owner has tendered it for repair. Failure to repair within sixty (60) days after tender of a vehicle is prima facie evidence of failure to repair within a reasonable time. The owner may be entitled to an identical or reasonable equivalent vehicle at no charge or to a refund of the purchase price less a reasonable allowance for depreciation.

Note: A fuel cap that is not sealing properly with the fuel tank filler neck may cause the vehicle to release air pollutants exceeding the U.S. Environmental Protection Agency (EPA), the California Air Resources Board (CARB) and Environment Canada standards resulting in potentially failing a state or local emissions inspection.

As defined in Title 40 of the Code of Federal Regulations, the California Code of Regulations and the Canadian Environmental Protection Act, as a manufacturer, we are also required to correct vehicles that may be emitting pollutants in excess of emission standards. These emission standards were established to protect the public health or welfare from air pollution. If you have questions about this notic
